Service agreement and privacy

Review the current version (2026-02-privacy-v3) and accept it before creating your account. This document covers our obligations under Colombian Habeas Data rules and how we process data with AWS, MongoDB Atlas, artificial intelligence, and WhatsApp.

This agreement explains how Pick handles your data when you create an account and use WhatsApp introductions. You must accept it to continue.


Controller and scope
  • Pick SAS, domiciled in Colombia (Bogotá D.C.), is the data controller.

  • Address: Calle 97A # 7A-24, Bogotá D.C., Colombia. Phone: 311 331 5304. Contact: pickglobalcontact@gmail.com.

  • The service is for adults 18+. It covers the web app, APIs, and WhatsApp/email communications.


Data we collect
  • Required data: email, password (managed by Cognito), and display name for your account.

  • Optional data: cities, interests, bio, profile photo (S3), and LinkedIn/Instagram links.

  • Match data: city/interest combinations, match codes, the introduction generated with artificial intelligence, and sponsor presence.

  • Usage and safety metrics: IP, device/user-agent, product events, logs, and abuse reports.

  • Comments you send to support or feedback forms. We do not request sensitive data; do not include it in free-form text.


Purposes and legal bases
  • Provide the service: create your account, suggest matches, generate and display the WhatsApp introduction message, and manage relevant sponsors.

  • Security and fraud/abuse prevention, including block lists, content moderation, and usage limits.

  • Product and quality analytics to improve the experience (optimizations, controlled experiments).

  • Operational communications (confirmations, safety alerts); marketing is optional and revocable.

  • Legal bases: prior, express, and informed authorization from the data subject; performance of the agreement; and compliance with legal obligations.


Habeas Data rights and contact channels
  • Access, update, correct, and delete data; request proof of authorization; be informed about use; file complaints; and revoke consent when applicable.

  • Responsible area: Pick SAS Privacy Team.

  • Procedure: send your request to pickglobalcontact@gmail.com with your full name, identity document, request description, and contact details.

  • Channel: pickglobalcontact@gmail.com. Inquiries are answered within 10 business days; complaints within 15 business days under Decree 1377 of 2013.

  • You may escalate to the Colombian Superintendence of Industry and Commerce (www.sic.gov.co) if you disagree with our response.


Processors and third parties
  • AWS (Cognito, API Gateway, Lambda, S3/CloudFront) for authentication, execution, and media; MongoDB Atlas for operational data.

  • The artificial intelligence provider (AWS Bedrock) only receives names, interests, city, and match code; we do not send phone numbers.

  • Analytics tools (Amplitude/PostHog) when enabled, under data-processing agreements.

  • Sponsors only receive aggregate metrics; we do not share your contact details without explicit authorization.

  • WhatsApp receives the message text and metadata when you open the deep link to start the conversation.


International transfers
  • Data may be stored or processed in the United States or other jurisdictions using contractual and technical safeguards (encryption, access controls).

  • By accepting, you authorize these transfers under Law 1581 of 2012 and applicable rules.


Retention
  • We keep account and profile data while you use the service.

  • Operational and security logs are retained for up to 12 months; backups for up to 90 days.

  • After a deletion request, we remove data except what is required for legal obligations or dispute resolution.

  • Database duration: during the relationship with the user and for the time needed to comply with legal or contractual obligations.


Security and incident notice
  • We encrypt data in transit, restrict access, and audit internal use. We will notify incidents as required by applicable law.

  • User duty: keep credentials secure and report suspicious access or content.


Communications and marketing
  • By creating an account, you authorize operational WhatsApp/email messages related to matches and safety.

  • Marketing and updates are only sent with prior, separate authorization; you can revoke it at any time.


Conduct, safety, and sponsors
  • Do not use Pick to harass, discriminate, spam, conduct illegal activity, or impersonate others. We may suspend accounts that breach these rules.

  • You are responsible for your safety in meetings; verify identities and meet in safe places. Pick does not control off-platform interactions or guarantee compatibility for every match.

  • Sponsored messages are labeled; do not accept third-party benefits that conflict with your local law or our rules.


Limitation of liability
  • Pick is provided "as is"; we do not guarantee uninterrupted availability or that every match will produce a specific outcome.

  • We are not liable for damages arising from user interactions or the use of information generated by artificial intelligence, except in cases of willful misconduct or gross negligence under Colombian law.


Minors, suspension, and termination
  • The service is not intended for people under 18; we will delete minors' data if we become aware of it.

  • We may suspend or close accounts for breaches of this agreement or security risks.


Governing law and jurisdiction
  • This agreement is governed by the laws of Colombia. Any dispute will be resolved before the courts of Bogotá D.C., unless we agree on an alternative dispute-resolution mechanism.


Updates
  • We will publish material changes and request renewed acceptance when required.
